REGISTRATION, PURCHASE, RANGE OF PRODUCTS AND SERVICES
AVAILABLE FOR PURCHASE ORDER PROCEDURE, DELIVERY
REGISTRATION/PURCHASE
1.1. By purchasing/registering on the website, the User declares that he/she has read and accepted the terms and conditions of these GTC and the Privacy Policy published on the website, and consents to their content.
1.2. During the purchase/registration, the User is obliged to provide his/her own real data. In the event of untrue or personally unidentifiable information provided during the purchase/registration, the resulting electronic contract will be void. Belladonna Luxury Lingerie Ltd (hereinafter referred to as the Service Provider) excludes its liability if the User uses its services on behalf of another person with the data of another person.
1.3. The Service Provider shall not be liable for any delivery delays or other problems or errors that may be traced back to the data provided incorrectly and/or inaccurately by the User.
1.4. The Service Provider shall not be liable for any damages resulting from the User forgetting his/her password or making it available to unauthorized persons for any reason not attributable to the Service Provider.
2. RANGE OF PRODUCTS AND SERVICES AVAILABLE FOR PURCHASE
2.1. The displayed products can be ordered online. The prices displayed for the products are in HUF or Euro (according to the User's choice) and include the statutory VAT.
2.2. In the web store, the Service Provider displays the name and description of the product in detail, and displays a photo of the products. There may be color differences between the color balance of the product in the images displayed on the product data sheet and the actual product due to differences in the calibration of different digital devices for which we accept no responsibility.
2.3. If a special price is introduced, the Service Provider will fully inform the Users about the special prices.
2.4. If, despite all the care of the Service Provider, an incorrect price is posted on the platform of the Web Store, especially with regard to the obviously incorrect, e.g. for a price of HUF “0” or HUF “1” that differs significantly from the well-known, generally accepted or estimated price of the product, possibly due to a system error, the Service Provider is not obliged to deliver the product at an incorrect price, but may offer delivery at the correct price, in the knowledge of which the Customer may withdraw from his/her intention to purchase.
2.5. In the case of an incorrect price, there is a striking disproportion between the actual and indicated price of the product, which an average consumer needs to perceive immediately. Pursuant to Act V of 2013 on the Civil Code (Civil Code), the contract is concluded by mutual and unanimous expression of the will of the parties. If the parties are unable to agree on the terms of the contract, i.e. there is no statement expressing the will of the parties mutually and unanimously, then we cannot speak of a validly concluded contract from which rights and obligations would arise. Based on this, an order confirmed at an incorrect/erroneous price will be considered a void contract.
3. ORDER PROCEDURE
3.1. After registering, the User logs in to the web store or may start shopping as a guest without registration.
3.2. The User selects the product, products, and selects the appropriate size.
3.3. The user adds the selected products to the cart with the “Add to cart” button. The Users can view the contents of the cart at any time by clicking on the “cart” icon.
3.4. If the User wants to add another product to the cart, he/she may select the "Continue shopping" button. If he/she does not wish to buy another product, he/she may check the number of products he/she wishes to buy. He/she can delete the contents of the cart by clicking on the "delete - X" icon. If everything is all right, the User may proceed with the “Pay” button.
3.5. In case the User has not logged in yet, he/she can do so here. He/she may also register on this platform to make future purchases easier, but he/she can also buy as a guest - without registration. The User fills in the billing, and the delivery data as well as the delivery/payment method, which are of the following types:
3.5.1. Payment methods:
- Credit card and ApplePay payment: Convenient and secure online payment provided by PayPal (Europe) S.à r.l.
Credit card details will not be sent to our store.
- Bank transfer: The final amount of the invoice will be transferred to the specified account. Upon receipt, we will prepare your package and hand it over to our courier service.
- Payment by cash on delivery: If the ordered product is delivered by courier service, it is possible for the User to pay the final amount of the order to the courier upon receipt of the product(s) ordered in cash or by credit card.
3.5.2. Shipping cost:
The delivery fee to the territory of Hungary is free of charge.
Outside the territory of Hungary, but to any country of the European Union, uniformly 5 €.
Outside the European Union, uniformly € 10.
3.6. If there is an error or defect in the products or prices in the web store, we reserve the right to make corrections. In this case, we will inform the customer of the new data immediately after recognizing and modifying the error. The customer may then confirm the order once again or there is a possibility for either party to withdraw from the contract.
3.7. The final amount to be paid includes all costs based on the order summary and confirmation letter. The invoice is included in the package. The user is obliged to inspect the package in front of the courier upon delivery, and in case of any damage to the products or packaging, he/she is obliged to request a minutes, and in case of damage, he/she is not obliged to accept the package. Subsequent complaints without minutes will not be accepted by the Service Provider. Packages will be delivered on business days between 8am and 5pm.
3.8. After entering the data, the User can send his/her order by clicking on the “order” button, he/she may also send a comment about the order, or he/she can inform us of other wishes related to the order by e-mail.
3.9. Correcting data entry errors: Before completing the ordering process, the user has the opportunity to return to the previous phase any time, where he/she can correct the data entered.
3.10. The user will receive an e-mail confirmation after the order has been sent. If this confirmation is not received by the User within the expected time limit, depending on the nature of the service, but no later than within 48 hours from the sending of the User's order, the User is released from the obligation to make an offer or a contractual obligation. The order and its confirmation shall be deemed to have been received by the Service Provider or the User when it becomes available to them. The Service Provider excludes his responsibility for the confirmation if the confirmation is not received in time because the User provided an incorrect email address during registration or is unable to receive a message due to the storage space belonging to his/her account is being full.
4. ORDER PROCESSING AND SALES AND PURCHASE FULFILLMENT
4.1. Orders are processed during business hours. It is also possible to place an order outside the timeframes indicated as the processing of the order. In case it is processed after the working hours, it will be processed the next day.
4.2. General delivery time is 2-3 working days. The Service Provider undertakes to publish (on the unique product pages) the predictable delivery deadline of each product with the utmost care.
4.3. Pursuant to the sales and purchase agreement, the Service Provider is obliged to transfer the ownership of the item, while the User is obliged to pay the purchase price and take over the item.
4.4. If the seller is an enterprise and the buyer is a consumer, and the seller undertakes to deliver the item to the buyer, the risk of damage passes to the buyer when the buyer or a third party designated by him/her takes possession of the item.
4.5. If the seller is an enterprise and the buyer is a consumer, unless otherwise agreed by the parties, the seller (according to these GTC: Service Provider) is obliged to make the item available to the buyer (User) without delay, but no later than within thirty days.
4.6. In the event of a delay by the Service Provider, the User is entitled to set an additional deadline. If the seller fails to perform within the additional period, the buyer is entitled to withdraw from the contract.
4.7. The User is entitled to withdraw from the contract without setting an additional deadline if
a) the Service Provider has refused to perform the contract; or
(b) the contract should have been performed at the agreed time of performance and not any other time, as agreed by the parties or because of the recognizable purpose of the service.
4.8. If the Service Provider fails to fulfill his contractual obligations because the product specified in the contract is not available to him, he is obliged to inform the User immediately and to refund the amount paid by the User immediately, but no later than within thirty days.
4.9. The Service Provider shall not be liable for any changes in the descriptions without prior notice to the Supplier or for reasons beyond his control. Service Provider reserves the right to reject orders that have already been confirmed in whole or in part. Partial performance may only take place after consultation with the User!
